Terms of Service

These terms are an agreement between you and Felikss Veilands, trading as FSMCore ("FSMCore", "we", "us"), a sole trader based at Apartment 205, Richmond Court, Mount Kennett Place, Dock Road, Limerick, V94 K316, Ireland. Contact: support@fsmcore.com.
1. Who these terms are for
FSMCore is business software for construction and trade companies. It is sold to businesses, not to consumers. By creating a company account, you confirm that you are at least 18 years old and that you accept these terms on behalf of the business you name (the "Customer"). The person who creates the account and anyone the Customer gives an admin or owner role can act for the Customer.
2. The service
FSMCore gives the Customer a private workspace on its own address (for example yourcompany.fsmcore.com) to manage clients, sites, jobs, calendar, time, estimates, invoices, files and related work. Features differ by plan, as shown on the Billing page in the app. We may improve, change or remove features. If we remove a feature that is a main reason for your plan, we will tell you at least 30 days before, and you may cancel and get a pro-rata refund for the unused prepaid period. We may change a company's web address if it uses a name or trademark the company has no right to use; the old address forwards for 90 days.
3. Free trial
New companies get a 14-day free trial. No card is needed. During the trial, bulk export of all company data is available, as on a paid plan. When the trial ends without a subscription, the company is locked (see section 8).
4. Plans, payment and taxes
Our order process is run by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms apply to your payment.
Subscriptions are billed monthly or yearly in advance and renew automatically until cancelled. Prices are shown on the Billing page in the app. Paddle adds VAT or sales tax where the law requires it. We will give at least 30 days' notice by email before a price change applies to your subscription; the new price applies from your next renewal after that notice.
If a payment fails, Paddle will retry. If it still fails, the company may move to past-due and then be locked as in section 8.
5. Cancelling and refunds
You can cancel at any time from the Billing page. Access continues until the end of the period you have paid for; then the company is locked as in section 8. Refunds are described in our Refund Policy.
6. Your data
The Customer owns all data it and its users put into FSMCore ("Customer Data"). We use Customer Data only to provide and support the service, and as described in our Data Processing Agreement, which forms part of these terms. Our Privacy Notice explains how we handle personal data about users and visitors.
You can export all company data at any time, also during the trial, and on the lock page after a trial or subscription ends.
7. Your responsibilities
The Customer is responsible for:
- the accuracy and legality of the data it enters, and for having a lawful basis to store personal data about its clients, staff and subcontractors;
- who it invites, the roles it gives them, and keeping passwords and two-factor devices safe;
- checking documents before sending them (estimates, invoices, tax treatment such as VAT or RCT). FSMCore calculates from the settings you choose; it does not give tax, legal or accounting advice;
- checking anything an AI feature drafts before relying on it (see section 9).
You must not: break the law using FSMCore; upload malware; try to access other companies' data or our systems beyond your own account; probe, scan or load-test the service without our written permission; resell or share the service outside your company; or use it to send spam.
8. Lock, export and deletion after a trial or subscription ends
When a trial ends without a subscription, or a paid subscription ends, the company is locked. While locked, an admin or owner can still sign in to the lock page to subscribe, export all company data, or delete the company data straight away.
If nothing is done, all company data is permanently deleted 30 days after the lock. We email reminders before the trial ends and 7 days and 1 day before deletion. After deletion, copies remain only in backups, which expire on their fixed schedule (at most about 7 months). Backups are used only to recover data after a failure or a mistake, never to bring back a deleted company.
9. AI features
A company can connect its own account with an AI provider (for example OpenAI, Anthropic or Google) using its own API key. When you use AI features, the content you send is passed to the provider you chose, under your own agreement with that provider. AI output can be wrong. Nothing an AI drafts is saved as a record until a user approves it, and the Customer is responsible for what it approves.
10. Availability and support
We aim to keep FSMCore available at all times and back it up daily, but we do not promise uninterrupted service and offer no uptime guarantee (SLA). Planned maintenance is done outside Irish working hours where possible. Support is by email at support@fsmcore.com on working days.
11. Suspension
We may suspend access, after warning where reasonable, if the Customer seriously breaks these terms, if an account is used to attack the service or other customers, or if the law requires it. We will restore access when the cause is fixed.
12. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Otherwise: we are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill. Our total liability in any 12 months is limited to the fees the Customer paid for FSMCore in those 12 months (or €100 during a free trial).
The service is provided for business use. To the extent the law allows, all warranties not stated in these terms are excluded.
13. Ending the agreement
The Customer can end this agreement by cancelling and deleting the company. We can end it with 30 days' notice by email, or straight away under section 11 if the breach is not fixed. On ending, section 8 applies to Customer Data. Sections 6, 8, 12 and 15 continue after the agreement ends.
14. Changes to these terms
We may update these terms. For changes that matter, we will email account admins and owners at least 30 days before they take effect. If you do not agree, you may cancel before they take effect and get a pro-rata refund of any prepaid period after that date.
15. Law and disputes
These terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction. Please contact us first at support@fsmcore.com so we can try to solve any problem.
